Welcome to the Foundry Mews  website (the ‘website’). By accessing this website, you agree to these terms and conditions (the ‘Terms’). If you do not agree to them, you may not use this website and should leave it immediately.

The following terms and conditions apply to all purchases made on Foundry Mews.

2 IMPORTANT NOTICE

Before placing an order please read through these Terms.

These terms apply when you purchase an item from this website. The Terms may be updated from time to time (for example to reflect changes in technology, our business model, our system capacity, or relevant laws and regulations), and we therefore ask you to accept the Terms and Conditions every time you shop with us. Any reference to "you" or "your" means you as a user of this website, any reference to "we", "us" or "our" means Foundry Mews.

If you do not accept these Terms, you cannot order or purchase products on this website.

 

2.1 PLACING AN ORDER

The online shop is open 24 hours a day but may be closed due to maintenance services.

An order placed on a Japan public holiday or during the weekend will be processed on the following business day.

2.2 Delivery address

We can only process your order if the delivery address is a residential address or a business address in the area we deliver to. 

Among other things, we reserve the right to cancel the contract of purchase in one of the following situations, without being liable for compensation or other costs:

Your payment details are incorrect or cannot be verified
Your order is placed with the purpose of committing fraud etc. or placed in connection with a criminal offense or other unlawful activities
There is an inadvertent error on this website, such as a payment error or the like
Contracts can only be concluded on this website. We do not process orders made in letters or faxes.

お届けした商品が明白な不良品に該当する場合は、商品の受け取り後3日以内に限り返品・交換を承ります。返送商品の検品後に不良品でないと判断された場合は返金不可となり、そのままご注文時の住所に返送となります。
自己都合返品のために意図的にダメージが与えられたことが、検品によって発見された場合は返金は不可となり、また法的措置を取る場合がございます。
不良品の場合、当方で送料を負担の上、返金いたします。
以下については返品の対象とはなりませんのでご注意ください。


・ご注文ミスが理由の場合
・着用した形跡がある場合
・商品の色合いや印象が写真と異なるといった理由の場合
・その他お客様都合の理由の場合
・商品の受取拒否の場合は再発送費用を決済会社経由で請求を行います。
・自己都合返品を装うためにダメージを与えた場合(発覚した場合は法的措置を取る場合がございます)
・当サイト以外で購入をした商品の場合:この場合の返品や交換、修理等はいかなる理由でも一切お受けする事ができません。ご購入の販売店へ直接お問い合わせをお願いいたします。
・万が一同一商品が品切れの場合は(銀行振込・paypal)でのご返金とさせていただきます。

・お客様のご都合による返品・交換(サイズが合わない、イメージ違い、ご注文間違えなど)は一切受け付けておりませんのでご了承ください。
 

2.3 ORDER VALIDITY

Before submitting the order, you have the option of changing the information that you have provided including payment information or delivery and billing information.

When you click "Complete order", enter your payment information and the receipt appears on your screen you are bound by the contract of purchase.

If you experience any problems or made a mistake while placing your order, please contact our Customer Care, that is open Monday-Friday 9 am to 5 pm.

Your order has been confirmed when you receive a confirmation email from Foundry Mews

After the conclusion of the contract, the provisions on withdrawal apply, see below.

2.4 ACCESS TO THE CONTRACT

You will receive a confirmation of the content of the contract by email. We store concluded contracts, including the order confirmation, for a reasonable amount of time, and we recommend that you save this information as well; they may not necessarily be available on this website subsequently. Please read more under "Order tracking and view history".

2.5 MEASURES AGAINST FRAUD

In order to protect you and our other customers from fraud and maintain a high level of security for online purchases, we may carry out verification checks. The verification check may comprise the data that you send when ordering, including your address and payment information.

 

3 MEANS OF PAYMENT

We accept the following means of payment:

Visa
Visa Electron
Mastercard
Mastercard Debit

We do not accept other methods of payment.

 

3.1 CVV (CREDIT CARD VERIFICATION NUMBER)

If you choose to pay by credit card, you will be asked to enter the card's security code. You will find the three-digit security code on the back of your credit card, usually on the right side of the credit/debit card's back. The security code is necessary for the payment to be processed and for maintaining a high level of security. There may also be other similar safeguards.

3.2 PAYMENT PROCEDURE

Once your order leaves our warehouse, your payment will be debited on the selected payment service. In some cases, we might reserve the order amount from your money account, but if the order is to be cancelled, your money will be released back to you.

 

4 DELIVERY AND PRICES
No additional taxes or customs duties are charged for products that are shipped within the Japan. If your FoundryMews order requires international shipping, please be aware that your order may be inspected by customs authorities.

4.1 DELIVERY  
We deliver to the Japan within 1month to make shoes * clothes can send 4-5 business days then we will ship to your home form japan 4-5 business days and Rest of World within 5-13 business days.

We will not be held responsible for any delay or failure to comply with its obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control such as if a package is lost by one of our carriers. This condition does not affect your statutory rights.


If you do not pick up the parcel or take any action regarding the delivery and the parcel is shipped back to us, we will charge a fee of 10000yen .
If the package is not picked up and any kind off fee is added, you are responsible for the extra cost and will be charged all costs and expenses associated with the return shipment. This includes freight charges, any extra payments, duties, taxes, return charges, any additional fees, etc.
Please note that the risk of loss of or damage to the products passes to you after delivery. If the package appears to be damaged or ripped open, you should refuse to receive the products. If you wish to complain about any lack of conformity, you are required to give notice to us. Please read more under "Non-conforming products and incorrect products".
We reserve the right to change the prices and are not responsible for any printing errors.

 

 

4.2 CURRENCY

The prices on the website are shown in USD and Yen only. Your card will be charged in USD or YEN.

4.3 ORDER TRACKING AND VIEW HISTORY

When you place an order on our website, you will receive a tracking number and link in a separate email to track your order via one of our courier’s websites. Please always contact Customer Care if you have questions regarding the status of your order.

 

5 RETURNS AND CANCELLATION 

 

We always hope that you are delighted with the items you purchase from Foundry Mews. However, if you need to return any items for any reason, you can find the necessary information below.

If you are uncertain about the sizing before making a purchase, please email us at customercare.fmews@gmail.com. Our product specialists are available to help you find the perfect fit.

Return Policy
• If you are not satisfied with your purchase from Foundry Mews, you may request a return within 14 days of receiving your item.
• Please note that items purchased outside our website cannot be returned, exchanged, or repaired for any reason. Please contact the retailer where the purchase was made directly.
• Customer is responsible for all shipping charges of returned items.
• An admin fee of 15 GBP, USD, or 2500 JPY will be charged for all returns of shoes coming from any country in the world.
• Customer service responses may take 3-4 days.

Return Requests
• Returns must be shipped back within 14 days of receiving the item. Outside of this return period, returns will not be accepted.
• We do not refund the original postage and packaging charge.
• We may make a deduction from the refund for loss in value of any goods supplied if the loss is the result of incorrect handling of the product.
• All items returned must be in an unworn condition with all tags and labels attached. Items returned with marks or damage will not be accepted.

Return Conditions
• Items must be unused and in their original condition.
• All original tags must be attached.
• Items must be returned in their original packaging.
• Items purchased with discount codes, sale items, or customized products cannot be returned.

Refund Process
1. Please request a return by emailing customercare.fmews@gmail.com.
2. Upon approval, follow the return instructions and send the item to the specified return address. Customer is responsible for all shipping charges of returned items.
3. Once the returned item is received and inspected, the refund will be processed within 7 business days. Refunds will be made to the original payment method used during purchase.

Refunds
• We will only refund the product price.
• Foundry Mews is not responsible for any loss or damage during the return shipment.
• If the returned item is determined not to be faulty after inspection, the refund will not be issued.

Return for Exchange
• Size exchanges are only available for the same model.
• Customer is responsible for all shipping charges of returned items.
• We will send you an invoice for the reshipping fee. Once the payment is confirmed and the item is ready, we will proceed with the shipment.

Faulty Items
• If you receive a faulty item, please contact customer service (customercare.fmews@gmail.com) within 14 days of receiving your order.

Long-Term Absence and Residence Issues
• If you are not available at the time of delivery, the courier will leave a notification.
• Please arrange for redelivery yourself.
• If the storage period expires, the package will be automatically returned to our warehouse.
• In such cases, an additional shipping fee will be charged for redelivery.
• Please ensure to receive your ordered items within the specified period.
• If you refuse to accept the delivery, the return shipping cost will be charged to you via the payment provider.

Other
• Foundry Mews reserves the right to change the return policy.

If the delivered goods correspond to an obvious defective item, we will accept returns or exchanges only within 14 days of receipt of the goods. If, after inspection of the returned goods, it is determined that the goods are not defective, no refund is possible and the goods will be returned directly to the address on the order.
If inspection reveals that damage has been deliberately done to the returned goods for your own reasons, no refund will be given and we may also take legal action.
In the case of defective goods, we will pay the shipping costs and refund the money.
Please note that returns are not eligible for the following


In the case of an order error.
If there are signs of having been worn.
If the colour or impression of the product differs from the photograph.
In the case of other reasons at the customer's convenience.
In case of refusal to receive the goods, the cost of reshipment will be charged via the payment company.
In the case of damage to the product to make it look like a return for personal reasons (legal action may be taken if this is discovered).
In the case of products purchased outside of this website: In this case, we cannot accept returns, exchanges or repairs for any reason whatsoever. Please contact the retailer from whom you purchased the product directly.
In the event that the same product is out of stock, the refund will be made by bank transfer or paypal.

Please note that we do not accept any returns or exchanges for reasons attributable to the customer (e.g. wrong size, wrong image, wrong order, etc.).

 

5.1 REFUND

Refund Process

1. Please request a return by emailing customercare.fmews@gmail.com.
2. Upon approval, follow the return instructions and send the item to the specified return address. Customer is responsible for all shipping charges of returned items.
3. Once the returned item is received and inspected, the refund will be processed within 7 business days. Refunds will be made to the original payment method used during purchase.

Refunds
• We will only refund the product price.
• Foundry Mews is not responsible for any loss or damage during the return shipment.
• If the returned item is determined not to be faulty after inspection, the refund will not be issued.

We will process refunds via bank transfer or PayPal.

After confirming the returned items, we will initiate the refund process and it will be completed within 7 business days.

Regarding extended absence or incorrect addresses, please arrange for redelivery based on the non-delivery notice from the shipping company. If items are returned to our warehouse due to storage deadline expiration, we regret that we cannot accommodate reshipments, refunds, or any other assistance. Please ensure that you collect your ordered items within the specified period.

For customers outside Japan, we do not provide refunds for customs duties or consumption taxes. If items are not received by customers, all related consumption taxes will be refunded to customers within Japan.

返金は銀行振込またはPayPalで行います。

返送された商品の確認後、返金手続きを受け付け、7営業日以内に返金いたします。

長期不在や住所不備に関する場合、配送会社からの不在通知に基づき、再配達手続きをお願いいたします。保管期限が切れた場合、商品は自動的に倉庫に戻されます。この場合、再配送や返金などの対応はいたしかねます。商品の受け取りは期間内に行ってください。

また、日本国外のお客様宛てに発送した場合、税関や消費税の返金は行いません。商品がお客様によって受け取られなかった場合、関連する全ての消費税が日本国内のお客様に対して返金されます。


ー長期不在・住居不備に関してー
お客様の不在の場合、配達会社より不在通知でご連絡致します。
お客様自身で、再配達依頼をお願い致します。
尚、保管期限切れの場合は、自動的に倉庫へ返送となります。
その際は、いかなる場合も再配送・ご返金等・全ての対応をお受けすることが出来ません。
ご注文された商品は、期間内にお受け取り頂きますようお願い致します。
 

6 NON-CONFORMING PRODUCTS AND INCORRECT PRODUCTS

If your products are non-conforming or we have delivered the incorrect products, please contact our Customer Care. You are not responsible for costs associated with the return of non-conforming or incorrect products. If you notice the non-conformity or we have delivered incorrect products at the time of delivery, you should refuse to receive the products.

In case of non-conforming or incorrect products, you can choose between the following options:


Return the product using the shipping label that Customer Care has emailed and instructed you to use and receive a refund of the purchase price after the return has been processed,
Return the products with a shipping label provided by Customer Care and receive similar products when we have processed the returned products, provided we can supply an equivalent, or
Keep the products and if the value of the products is less than the originally ordered products you will receive a discount for the difference in price.
When contacting Customer Care you will be asked to provide the order number, and to describe what is wrong with the products including a picture with a file size under 1 megabyte.

7 OTHER MATTERS

We do our best to update our website and to ensure that prices, offers, descriptions and other information concerning the products are correct. Typographical errors and errors in prices, offers, descriptions and other information concerning the products may occur, and sometimes we discover that the prices on goods are incorrect.

7.2 FORCE MAJEURE

We are not responsible for delays or failure to meet our obligations in relation to these Terms and Conditions, if the delay or the non-compliance is due to events beyond our control.

7.3 THE COMPLETENESS OF THE CONTRACT

These Terms and Conditions constitute the complete terms of the contract between us.

 7.4 INVALIDITY

If one or more of the provisions in the Terms and Conditions are declared fully or partially invalid, the remaining provisions still apply.

7.5 ASSIGNMENT

We are entitled to assign our rights and obligations under the contract with you to third parties. The standard of the service you receive will not be impaired by the assignment. We will notify you of such possible assignment. By accepting these Terms and Conditions you consent to any such future assignment. At the same time, you agree that from the time when we have given you notification of the assignment, your rights may be claimed only against the third party in question.

 7.6 PRIVACY POLICY

We treat your personal data confidentially. Please read our Privacy Policy that explains how we use the personal data that you provide in connection with the ordering procedure, and your use of this website in general.

7.7 RIGHT TO COMPLAIN

In case you wish to complain about products purchased from us, please contact our Customer Care.


7.8 CHOICE OF LAW AND JURISDICTION

Any contracts concluded between us using these Terms and Conditions are governed by Japan law. Any dispute which may arise in connection with our contract, including its existence or validity, must be brought before a competent court in Japan. As a consumer you may bring proceedings against us in the courts for the place where you are domiciled.
